Terms of Service

These Terms of Service ("Terms") govern your use of Promethic, a product of Soulware Studio LLC ("we", "us", "our"). By accessing or using Promethic, you agree to be bound by these Terms. If you do not agree, do not use the service.

Promethic is currently in beta. Features, pricing, and availability may change as the product evolves.

1. Account Registration

To use Promethic, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

You must be at least 13 years of age to create an account and use Promethic. By registering, you represent that you meet this requirement.

2. Free Trial and Subscription

New accounts receive a 14-day free trial with a $3 usage credit for LLM processing. During the trial, you have full access to Promethic's features including cloud storage and LLM-powered conversions.

After the trial period ends, a paid subscription is required for continued access to cloud storage and LLM usage. Local-only features remain available without a subscription.

3. Acceptable Use

You agree to use Promethic in a lawful and responsible manner. You may not:

• Use the service for any illegal or unauthorized purpose
• Attempt to circumvent rate limits, usage quotas, or other technical restrictions
• Interfere with or disrupt the service, servers, or networks connected to the service
• Reverse engineer, decompile, or disassemble any part of the software
• Use the service to generate content that violates applicable laws or third-party rights
• Share your account credentials or allow others to access the service through your account

4. Intellectual Property

You retain full ownership of the prompts you create and the outputs generated through your use of Promethic. Your content is yours.

Promethic, including its software, design, branding, and documentation, is the intellectual property of Soulware Studio LLC. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the service as intended.

5. Third-Party Services

Promethic uses OpenAI's API for LLM processing, including text generation, image generation, and other AI-powered features. Content you submit for processing is sent to OpenAI's servers and is subject to OpenAI's Terms of Use and usage policies.

We are not responsible for the availability, accuracy, or content of third-party services. Generated outputs may not always be accurate, appropriate, or complete.

6. Limitation of Liability

Promethic is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

As a beta product, Promethic may contain bugs, experience downtime, or undergo significant changes. To the maximum extent permitted by law, Soulware Studio LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue arising from your use of the service.

7. Data and Privacy

Your prompts, outputs, and usage data stored in Promethic's cloud are your property. We do not sell your data or use your content to train models. For full details on how we handle your information, see our Privacy Policy.

8. Termination

You may stop using Promethic and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service.

Upon termination, you may export your data before your account is closed. We will make reasonable efforts to provide you with an opportunity to retrieve your content.

9. Modifications to Terms

We may update these Terms from time to time to reflect changes in the product or applicable law. When we make material changes, we will notify you via email or through an in-app notification. Your continued use of Promethic after such notice constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of Promethic shall be resolved in accordance with applicable U.S. law.
